MINUTES OF THE MEETING HELD WITH  MEMBER/PER  HELD ON 22-01-2014

Minutes of meeting with Member (Per) ,OFB on 22/01/2014  held at Ordnance factory board. Meeting was attended by Office bearers of both Association of NDGBOA and IOFGOA .In this meeting NDGBGOA has kept 27  vital points. NDGBGOA has strongly kept its views on following points before the Board officials.

                           On behalf of Central Executive Committee, Shri Jaigopal Singh GS/NDGBGOA express his thanks to the Hon’ble Member (Per) for accepting request and granted meeting on 22-02-2014 to discuss Group ’B ’cadre related   issues at O.F.Board, Kolkata (W.B).

                  Meeting started with discussion over following agenda points by NDGBGO Association

1.       Promotion to AWM post – against DPC 2013 and 2014. Advance DPC for the year 2014-15.

OFB Reply - The proposal submitted to UPSC has been returned back with observations regarding reservation policy of Govt of INDIA. This issue can be addressed only by DOP&T. M O D has been requested to take up the matter with DOP&T.

2.       Position of Cadre Review proposal submitted earlier for Group’B’ Gazetted Officers(JWM Tech/Non Tech and PS). Cadre review of Group B to be harmonized with Group A to settle pyramid hierarchy of post from Chargeman to DGOF.

OFB Reply – Cadre review proposal has been submitted to MOD vide letter no OFB I.D. dt 24/12/2013 as per the directives from Secretary/MOD/DP. Accordingly 1000 post of JWM(SG-I)in Grade pay of 5400 in PB-III , 2746 post of JWM (SG-II) with Grade Pay of 5400 at PB II. Rest of the JWM  at 4600 Grade Pay.
In this regard NDGBGOA asked clarification regarding the nature of work which will be performed by these three cadres of JWMs and demand for 5400 in PB- III for total 3746 JWMs by combining JWM SG-I and II. 

Finally Member/Per requested both the association to go through the proposed cadre review from OFB submitted at MOD. He express that if both the Assn are not satisfied with this proposal, then  make a common proposal which will be submitted to MoD and the earlier proposal will be withdrawn.
                OFB has given copy of submitted proposal.

3.       Revoke Cancelled Transfer Order of JWM before implementation of Transfer Policy .All Transferee JWMs may be released . Processing of pending cases on compassionate grounds.

All cases will be processed for due consideration by Standing committee shortly. In this connection NDGBGOA has strongly protested and told that in last two meetings, Board officials have assured that cancelled Transfer order will revoke but till date no action has been taken.  Then Member/per assured that   O.F.Board   will take necessary steps for revoking the cancelled transfer order in the 1ST Priority. Other transfer which is pending for compassionate ground will also be released with approval of the committee very soon. 

4.       OFBa, OCF Shahajahanpur and CFA may be included as hard stations in transfer policy and priority may be given to employees from these units during inter factory transfer. Minimum period of stay in parent unit in case of mutual transfer to be removed.

Member(Per) instructed to review the list of hard station and add these 3 stations along with Korwa project in the list of  after due examination.
5.       Before taking any sort of policy decisions and demand submission to 7th Pay Commission in case of Group B Gazetted officers, matter should be taken up with concerned association representatives.
 
              Member (Per) agreed to the point but stated that in some incidents MOD or DOPT requires some    
             Queries within very short period and in such instances it is not feasible every time to consult the   
             Associations. However all important communication will also be communicated to associations as well.

6.       Equal no of AWM post may be filled as against direct recruitment of AWMs since 01-01-2006.

Matter will be cleared upon clearance of 2014-15 DPC as nearly number of promotional post are nearly covered in 2014-15 DPC.

7.       Nature of Duties of JWM(T/NT)  may be published  to all Ordnance Factories.
In this point, Member (per) OFB replied that this is Brain Storming process which can be exactly defined after implementation of new cadre review and new SRO. Moreover he assured that JWMs are the managers in the section levels.

8.       MACP Benefit to be given to  JWMs and PS as per Promotional Hierarchy as per directives of CAT Chandigarh, High Court Chandigarh, Principal CAT New Delhi.
In this regard Dir/Admin replied that the matter was taken up with Mod two times. MoD has taken up the case with Dop&T. DOP&T has also taken up with Ministry of Finance. Now the matter is pending at MOF. Once it is cleared it will be cleared then DOP&T will issue the ORDER.

9.       Railway reservation for Temporary duties from units may be assisted by taking up for defence quota with respective DRMs on OFB level.
Member (Per) suggested to Dir /ADMIN to take up the matter with RAILWAY BOARD through MOD/DP for ORDNANCE QUOTA. In this regard DRM nearer to ORDNANCE FACTORY may be requsted.

10.   Stagnation of JWMs – New cadre review policy to be finalized to avoid future stagnation.
Cadre review proposal has been submitted to OFB and copy provided. Comments asked on proposal from both Associations.


11.   Removal of Anomalies in Promotion from JWM to AWM promotion in O.F.Board.
 Matter will be Cleared soon after clearance by UPSC.
      
12.   Annually Publishing of Seniority List of JWM(T/NT) and PS.

Action under progress and list will be published shortly.  Seniority list of JWMs up to 2012 will be published In the first week of February 2014.

13.   Revision of SRO and Recruitment Rules for JWM(T/NT) and PS. Amendment in classification of post     
from ‘Group B gazette-Ministerial” to “Group B Gazetted-Manegerial” prior to constitution of 7th CPC.
Proposal for revision of SRO is already submitted.DDG/NG replied that as there is no provision of making of Managerial in SRO JWM cadre has made as GROUP B GAZETTED, “NON MINISTERIAL” in new SRO.

14.   Restoration of Unauthorized withdrawal of Promotion Benefits i.e Incremental Benefit who have earned   promotion after 1-1-2006 to 29-08-2008 before implementation of 6th CPC Report.

This matter is under examination by Admin group. Dir Admin requested Association to clarify the point by which she can convince to PCof A. Accordingly Association has asked time up to 30th JANUARY to clarify the points.

15.   Fixation of pay on higher scale (Pre revised ) for merged post due to higher scale of responsibilities.
This matter is under examination by Admin group and will be cleared soon. After meeting, NDGBGOA met with DIR/A/A and discuss this matter separately and DIR/A/A assured that this problem will resolve shortly. 

16.   Granting of PLB  to Group ’B’ Gazetted Officers(JWM and PS).
The existing order for payment of PLB to the employees does not cover Group A and B gazette Officers. Initiation will be taken up with MOD for consideration.  

17.   Set up of Separate Mechanism for settlement of Grievances of Group’B’ Gazetted Officer. Since there is no representation from Group’B’ Gazetted  Association in  JCM Forum.

Member (per) agreed upon for quarterly meeting. Two meeting with JS/MoD and Two meeting with O.F.Board.

18.   Creation of JWM/SG in pay band of 5400 PB-III instead of PB-II.

Officials of O.F.Board  informed that Same has been proposed in new carde review proposal. 2746 post in  5400/-  PB-II and 1000  post  in 5400/-PB-III. Copy of cadre review proposal   has been given to  both concern association and suggestion/comments  asked in this regard.

19.   Issue of instruction to all units regarding issue of briefcases to all Group B Officers at par with OFB.

Circular to all units will be issued  shortly.

20.   Forwarding of applications for outside employment for carrier progression.

A policy has been finalized and soon will be forwarded to all units.


21.   Risk allowance to be given to all JWMs involved in production and maintenance of Explosive and hazardous materials.

        Proposal for JWMs and CMs working directly with chemicals and hazardous materials should be given with risk Allowance and the same is at MOD for approval. Member (PER) instructed to review the matter and expedite the same.

22.   Incentives and PLB may be given to all Group B Officers for better motivation since they form a vital role in production activities.

       New policy will be introduced into 7th CPC proposal.OFB request Associations to make proposal and take up the matter in 7th CPC and the same will be proposed by OFB.

23.   Writing of APARs of JWM by another JWM is strongly protested by this association. Matter may pl be taken up as it is non-productive and discriminating issue for all Group B officers.

Matter is kept on hold by OFB, GS/NDGBGOA emphasized over proposal to be withdrawn.

24.   Formation of separate section at OFB level (Other than Group A/NG) to reduce in-ordinate delay in dealing of matters related to Group B Gazetted officers.

New man-power will be posted to section A/NG for exclusively dealing with Group B gazetted matters.

25.   Stopping of deployment of JWMs in production plant and shift duties.

This will be implemented after fresh recruitment of CM  which is under process  and appointment will be shortly.

26.   All Gazetted Officers should be exempted from punching similar to OFB.

Instruction for punching was issued due to security reasons not for the attendance. In the present scenario all the ministries are implementing the same.

27.   President and General Secretary of Gazetted Officers association may be allowed to use mobile phone inside factories for better communication with all concerned.

Permission will be granted. In case of A&E Group, it will be restricted up to   Admin Sections.

DOP&T ORDER ON PAY FIXATION

Dopt issued clarification orders on fixation of Pay of Assistants of CSS in the Revised Pay structure as per the CCS (Revised Pay) Rules, 2008

Office Memorandum

Subject : Fixation of Pay of Assistants of CSS in the Revised Pay structure as per the CCS (Revised Pay) Rules, 2008 – Clarification regarding.

The undersigned is directed to say that references are still being received from Ministries/Departments regarding fixation of pay of Assistants in the revised pay structure. In this connection OM of even number dated 22.12.2010, enclosing there with Department of Expenditure UO No.10/1/2009-IC dated 14.12.2009, refers.

Instructions issued by this Department have to be read along with the under mentioned Rules and orders (as clarified, wherever required):

(i) Department of Expenditure’s OM No.1/1/2008-IC dated 30th August, 2008, para 2(ii)

“The tables in Annex-I will be applicable in cases where normal replacement pay scales have been approved by the Government. In cases of upgaradation of posts and merger of pre-revised pay scales, fixation of pay will be done as prescribed in Note 2A and 2B below Rules 7(1) and in the manner indicated in illustrations 4A …..“

(Therefore in the case of Assistants of CSS who have been given the upgraded post, the fixation of pay is to be done as prescribed in Note 2A below Rules 7(1) of CCS(RP) Rules, 2008)

(ii) Note 2A below Rule 7 of CCS(RP) Rules, 2008

"Where a post has been upgraded as a result of the recommendations of the Sixth CPC…. the fixation of pay in the applicable pay band will be done in the manner prescribed in accordance with Clause (A) (i) and (ii) of Rule 7 by multiplying the existing basic pay as on 1.1 .2006 by a factor of 1.86 and rounding the resultant figure to the next multiple of ten. The grade pay corresponding to the upgraded scale will be payable in addition. Illustration 4A in this regard is in the Explanatory memo to these Rules”.

(iii) Rule 11 of CCS (Revised Pay) Rules, 2008

"11. Fixation of pay in the revised pay structure subsequent to the 1st day of January, 2006. - Where a Government servant continues to draw his pay in the existing scale and is brought over to the revised pay structure from a date later that the 1st day of January 2006, his pay from the later date in the revised pay structure shall be fixed in the following manner :-
(i) Pay in the pay band will be fixed by adding the basic pay applicable on the later date, the dearness pay applicable on that date and the pre revised dearness allowance based on rates applicable as on 1.1.2006. This figure will be rounded off to the next multiple of 10 and will then become the pay in the applicable pay band. In addition to this, the grade pay corresponding to the pre-revised pay scale will be payable….”
(The fitment tables given in the Annex-I to the Department of Expenditures OM dated 30.8.2008 are to be used for pay fixation as done on 1.1.2006 only and incase of normal replacement pay scales as per para 2(i) and para 2(u) respectively of the aforesaid OM For fixation of pay in the revised pay structure subsequent to 1.1.2006, the Rule 11 of CCS(RP) Rules, 2008 refers).

2. The issue of fixation of pay with references to the pre-revised pay scale of Rs.7450-11500 and payment of arrears was taken up by Establishment Division of this Department with Department of Expenditure. A clarification dated 10.12.2013 issued by Estt (Pay) is enclosed.

3. It is further clarified that inclusion in the Select List does not ante date the seniority of the officers. However, the Select Lists as specified in this Departments OM No.6/3/2009CS.I(S) dated 9.7.20 10 may be deemed to be effective from 1st July of the year of the Select List, for the purpose of fixation of pay on notional basis only.

Vide the U.0. dated the 14th December, 2009, D/o Expenditure had allowed fixation of pay with reference to the pre-revised pay scale of Rs.7450-11500 to those promoted as Assistants / PAs between 1.1.2006 to 31.8.2008. They were, however, not allowed arrears from 1.1.2006 till the date of their promotion, as they had come over to the revised pay on the date of their promotion.

2. Seniors to such promotee Assistants / PAs, however, were subsequently allowed stepping up of their pay with reference to these officials. Such senior officials were also not allowed arrears on the ground that the officials with reference to whom they had got their pay stepped up were also not entitled toso.

3. The issue has been reconsidered in consultation with D/o Expenditure as this amounts to compelling the senior official, who was already serving as Assistant /PA prior to 1.1.2006 and opted for fixation of his pay under revised pay rules from 1.1.2006, to opt for revised pay structure from the date of stepping up with the junior.

4. It is, therefore, clarified that the senior is entitled to arrears of pay from the date he opted to come over to the Revised Pay Scales till the date of stepping up of pay. These will be paid on the basis of pay actually fixed as on 1. 1.2006.

5. The CS Divisions are, therefore, advised to issue a clarification in respect of similarly placed persons in CSS / CSSS.

THE ASSOCIATION ACTIVITIES IN THE RECENT PERIOD ARE AS FOLLOWS.

1- NATURE OF WORK AND FINANCIAL BENEFITS OF JWMS-
NDGBGOA/CFA BRANCH HAS FILED THE CASE ON NATURE OF WORK AND FINANCIAL BENEFIT AGAINST THE REPLY FROM OFB AT CAT CHENNAI.THE OA NO -1763/2013. IN THIS REGARD NOTICE HAS BEEN ISSUED TO THE OFB,MOD AND MOF. THE FIRST HEARING IS ON   10/02/2013.  
CE TEAM EXPRESS ITS BEST WISHES TO NDGBGOA/CFA BRANCH.

2-CADRE REVIEW OF JWM CADRE-
 NDGBGOA/OFT BRANCH IS PREPARING TO GO FOR CONTEMPT OF COURT . HONORABLE CAT,CHENNAI HAS GIVEN DIRECTION TO OFB TO COMPLETE THE CADRE REVIEW OF JWM CADRE WITHIN SIX MONTH PERIOD WHICH IS NOT YET COMPLETED. DUE TO DELAY IN CADRE REVIEW OF JWM, OFT BRANCH WILL APPROACH HONORABLE CAT FOR CONTEMPT BY WHICH THE CADRE REVIEW CAN BE FINALISED WITH CONSULTATION WITH ASSN BY OFB SOON.

3- GRANTING OF MACP IN PROMOTIONAL HIERARCHY(REMOVAL OF GRADE PAY OF 4800 FOR JWMS IN MACP) - ALL ARE AWARE THAT PRINCIPAL BENCH (CAT),NEW DELI AS WELL AS SUPREME COURT HAS GIVEN DIRECTIVES TO GRANT MACP IN PROMOTIONAL HIERARCHY.EVEN IN DOP&T JCM MEETING (NOV-2013), THE MATTER WAS DISCUSSED AND IT WAS REQUESTED FOR A FINAL ORDER FROM DOP&T. THIS WAS DISCUSSED IN THE LAST MEETING AT OFB ALONG WITH THE ASSN AND JOINT SECY, MOD ON 30TH OCTOBER 2013. OFB HAS ALSO SENT TWO REMINDER TO MOD AND DOP&T. THERE IS NO CONFUSION IN THIS ISSUE. IT IS EXPECTED THAT DOP&T WILL ISSUE THE ORDER VERY SOON. IN THIS REGARD OUR ASSN HAS TAKEN UP THE WITH DOP&T AND CDRA FOR EARLIY IMPLEMENTATION.

4- PROMOTIONAL INCREMENT FOR CM-II TO CM I AND AF TO JWM(BETWEEN 01/01/2006 TO 01/09/2008) RECENTLY SRI KENJOLE BR SECY/AFK  HAS VISITED OFB AND DISCUSSED THE SAME. IN THIS REGARD OFB AND FACTORIES ARE NOT TAKING ANY CORRECTIVE DECISIONS.ASSOCIATION HAS ALREADY COMMUNICATED TO OFB AS WELL AS MOD MANY TIMES. FINALLY OUR ASSN IS PREPARING TO APPROACH COURT OF LAW FOR RESTORATION OF PROMOTIONAL BENEFIT.

5- APAR OF JWMS - OFBOARD WAS TRYING TO TAKE DECISION ON  INITIATION OF APAR OF JWM CADRE BY HOS (JWM) IN THE NOVEMBER BOARD MEETING. OUR ASSOCIATION HAS TAKEN UP THE MATTER WITH MOD AND FORWARDED A LETTER ON 18/12/2013(PUBLISHED ON 20/12/13 IN BLOG) BY QUOTING SUPREME COURT ORDER(1996 AIR 1328,1996 SCC (7) 470 DATED- 08/02/1996. DDG/NG  ASKED CLARIFICATION OVER PHONE ABOUT THE SUPREME COURT ORDER . I HAVE MADE CLARIFICATION AND SENT A COPY OF THE SUPREME COURT ORDER TO OFB. FINALLY  IN THE DECEMBER BOARD MEETING THE PROPOSAL WAS KEPT IN ABEYANCE.

   I WOULD LIKE TO THANKS ALL THE CE TEAM FOR THEIR EFFORTS FOR COLLECTION OF DOCUMENTS.  

ALL THE ISSUES WILL BE DISCUSSED IN OUR FORTH COMING BGCM AND CORRECTIVE ACTION WILL BE TAKEN.
